Accident and Emergency care

We all know that Accident and Emergency Departments are extremely busy places that deal with life threatening emergencies, accidents, injuries and sudden illnesses, resulting in long waits to be seen either by a triage nurse, a doctor or both.

The NHS Constitution sets out that a minimum of 95% of patients attending an A&E Department must be seen, treated and then admitted or discharged in under four hours. This is one of the ‘core standards’. As a result of the volume of traffic through the Department, and the pressure placed upon staff to meet those time targets, a number of conditions are missed or not diagnosed and referrals to the appropriate specialist team are not made with, in some cases, catastrophic consequences.

However, regardless of department pressure, you are entitled to receive the best care available.

Types of Accident and Emergency Mistakes

  • Delay in treatment and/or delay in referring to relevant speciality
  • Delay in recognising and appropriately managing a condition
  • Failing to diagnose
  • Failing to take an adequate history
  • Failing to triage and prioritise correctly
  • Failure to identify the deterioration of a patient
  • Failing to carry out appropriate investigations
  • Failing to review the test results or misinterpreting the test results
  • Failing to refer to a specialist or specialist unit
  • Failing to obtain a senior opinion
  • Insufficient staff
  • Medication errors
  • Surgical errors
  • Wrongly sending a patient home

Any of the above may result in additional injuries, or illness, because of inadequate care or treatment, misdiagnosis or undiagnosed conditions.

How Can We Help You?

When medical treatment goes wrong, only lawyers with expert legal knowledge will do. Here at Joseph James Law we recognise the effect that a catastrophic injury can have. We understand that a serious, and in some cases fatal, injury can be a severe financial, physical and psychological burden on the whole family. We understand the importance of compensation and can help you obtain a settlement that will help with any financial and future care needs that you may have.
