Surgical Negligence Claims

No surgery is risk free. There are benefits and risks to all surgical procedures and it is important that you are aware, not only of the general risks of surgery, but also the additional risks for the specific type of surgery undertaken.

Some people may develop complications simply as a result of the surgery itself and not as a result of any medical negligence. However, serious medical mistakes, can and do, happen.

General Surgical Errors

Negligence by surgeons, or other members of the surgical team can be due to:

  • Operating on the wrong part of the body
  • Performing the incorrect procedure
  • Leaving a foreign object inside the body
  • Perforation or puncture of organs resulting in haemorrhage
  • Iatrogenic injury (injury inadvertently caused by a doctor)
  • faulty or misused instruments
  • lack of training

Anaesthetic Errors

Most problems occur as a result of the surgery itself and not the anaesthetic.  Anaesthetics are used during surgery to numb sensation or certain areas or to induce sleep to prevent pain.

Commonly used anaesthetics are:

  • Local - this is used during minor procedures and you remain fully conscious
  • General - used during surgery and you are unconscious

There are also a number of other types of anaesthesia such as:

  • Regional
  • Epidural
  • Spinal
  • Sedation

Although rare, anaesthetic errors or equipment failure can have devastating consequences:

  • Failing to intubate correctly- failing to keep the airway open can result in catastrophic brain damage and/or stroke
  • Nerve damage and/or paralysis caused by injections, epidurals and nerve blocks resulting in serious disability
  • Anaesthetic awareness – being conscious during an operation under general anaesthetic
